So Steve, illuminate this for me; why are you having to go through all this CARB rigmarole? Is it because your the 1st to get an '09 model?

Supposedly all performance numbers are the same even though torque is developed later later in the RPMs.

Mine is in the first run of 2009 335's brought here and the engine needed to be re-certified because of several tune AND part changes in the fuel/emissions related systems. What Mike posted might be true, might not be, its the internet buzz and its obviously denied by BMW. The first regular x35/N54 cars were originally scheduled for the last week of October or so well after CARB approval was scheduled. CARB was late, and BMW was early. So, it created a two week hold where none had been expected. And it made the ports a little crowded I suspect. My dad seemed a little frazzled with 700-800 cars manually held out of the normal prep and send system and then manual fed back into the system.
The software update supposed delayed torque peak by 1500 rpms. No indication that that is still the case with the 2009 as parts were changed in the fuel delivery system. So, the prog 29.2 might have just been a crude patch. Regardless the car's specs which include showing 300 ftlbs of torque held constant 1400-5000rpm have not changed for 2009.
The greater controversy with prog 29.2 flash upgrade was in the rumored inclusion of a hidden trap for changes in tune. If you installed a different tune, even if you set it back, the hidden trap would register the change and you're warranty was placed in jeopardy. I would imagine that the 2009 cars include this, but publicly there is no information and my dad had no idea about any of this stuff.
