Got a question that I figure someone's gotta be a psuedo or real expert on. I just got a parking ticket that was complete BS. I'm going to fight it, but the person hearing the arguments and making the decision is a police officer. This seems like a conflict of interest, since the police are the ones who will benefit from my $38. Isn't there some sort of legal provision that allows you to have your case heard by an arbitrator or other non-interested party? Anyone know the law in this case?

I bet you find that you have the right to appeal to an independent hearing officer for a trial de novo (fresh start), but you have to go through the initial hearing with the cop. You'll lose that one... But you knew that.

It's the reverse for moving violations. TBM (Trial By Mail) first...then if you lose you can request as Steve mentions "Trial De Nuovo" (i.e. latin which means New Trial). That's where you'll face the cop (if he shows up), and the outcome is in NOT in your favor (kinda like in Vegas where the house always wins).

It'll actually be worth it to be a pain in the ass to the cop. She needs to take a dip in the River Phlegton.
